These Terms of Service (“Terms”) govern your access to and use of the HostingNodes website, dedicated server hosting services, and related products (collectively, the “Services”) operated by HostingNodes (“we”, “us”, or “our”). By creating an account, ordering a server, or otherwise using our Services, you agree to these Terms.

If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use our Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Our Services

HostingNodes provides dedicated server hosting and related infrastructure services, including server provisioning, network connectivity, and customer support. Specific features, hardware specifications, and service levels are described on our website and in your order confirmation.

We may modify, suspend, or discontinue any part of the Services at any time. We will make reasonable efforts to notify you of material changes that affect active services.

3. Accounts and Security

You are responsible for:

  • Providing accurate registration and billing information
  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Securing your server operating system, applications, and data

Notify us immediately at legal@hostingnodes.com if you suspect unauthorized access to your account.

4. Acceptable Use

You may not use our Services to:

  • Violate any applicable law or regulation
  • Infringe intellectual property or privacy rights of others
  • Send spam, phishing messages, or other unsolicited bulk communications
  • Launch denial-of-service attacks or distribute malware
  • Mine cryptocurrency without an approved plan or explicit authorization
  • Host content that is illegal, abusive, or promotes violence or discrimination

We reserve the right to investigate violations and suspend or terminate Services that violate this policy or pose a risk to our network, other customers, or third parties.

5. Orders, Billing, and Payment

  • Fees are billed according to the plan and billing cycle selected at checkout
  • All prices are listed in USD unless otherwise stated
  • Payment is due in advance for each billing period
  • Failure to pay may result in suspension or termination of Services
  • You are responsible for applicable taxes unless we are required to collect them

Refunds are handled according to our refund policy stated at the time of purchase. Setup fees and third-party licenses may be non-refundable.

6. Service Level and Support

We target the uptime levels described on our website and in applicable service level agreements (SLAs). Scheduled maintenance will be announced in advance when practicable.

Support is provided through the channels listed on our website. Response times vary by plan. Support covers platform and network issues; we do not manage custom application code unless otherwise agreed in writing.

7. Your Content and Data

You retain ownership of content and data stored on your servers. You grant us a limited license to host, transmit, and back up your data solely to provide the Services.

You are solely responsible for:

  • The legality of content you host
  • Maintaining your own backups
  • Compliance with data protection laws applicable to your use of the Services

We are not liable for data loss. We recommend maintaining independent, off-site backups of all critical data.

8. Intellectual Property

The HostingNodes name, logo, website, documentation, and platform software are our intellectual property. You may not copy, modify, or reverse engineer our proprietary systems except as permitted by law.

You may use our trademarks only with our prior written consent.

9. Suspension and Termination

We may suspend or terminate your access to the Services if you breach these Terms, fail to pay, or if continued service poses a security or legal risk.

You may cancel Services according to your plan terms. Upon termination, you are responsible for exporting your data before access is revoked. We may delete data from terminated servers after a reasonable retention period.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTINGNODES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless HostingNodes, its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Material changes to active customers will be communicated by email or account notification where appropriate.

Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.
